Ogun State Government has restrained the Fibiwoga family from claiming ownership to 350 hectares of land along Lagos Road, Apere Oba via Ijebu-Ode, saying the land in question falls under government acquisition
The State Government cautioned the general public against buying land from land grabbers, so as not fall victims of land speculators in the State.
The State Attorney General and Commissioner for Justice, Mr. Oluwasina Ogungbade SAN, while addressing newsmen at the Ministry’s Conference Hall stated that it has uncovered a fraudulent and improperly obtained customary court judgment with which some land grabbers intend to sell government land at Apere Oba in Odogbolu Local Government Area.
According to Ogungbade, “A few months ago, the Ministry received a petition from persons representing linage and descendants of one Oba Alli Ogunnaike Fibiwoga, claiming they were properly adjudged owners of a family land within Odogbolu Local Government, but were disturbed in possessing the land by violent trespassers.
They also presented a survey plan showing the 350 hectares of land, but further investigation of the complaints and scrutiny revealed that the land belonged to the State government “.
The Attorney General further explained that the entirety of the land claimed by the Fibiwoga Family falls within government acquisition, where two large universities were situated on separate parts of the land while other allottees were on the other part.
He stressed that the judgment obtained at the customary court was both fraudulent and improperly obtained because the complainants who approached the court as plaintiffs knew that the land belonged to the State government but proceeded nonetheless to obtain the same, while excluding the State that had an obvious interest in the land.
“The judgment obtained by Fibiwoga Family never described that the land was awarded to them and the plaintiffs, in that case, did not plead a survey plan before the Customary Court in the reliefs it granted, Fibiwoga Family did not even mention the size of their land in all documents filed in court.
It was after the judgment had been delivered that the Fibiwoga Family attached its current plan to the judgment of the Customary Court, also the survey plan was never the basis of the order granted and cannot be the basis of any execution today,’’ he said.
It added that none of the named defendants were served with notice of the suit while trial and judgment curiously occurred on the same day again without notice to the named defendants.
Informing that the Fibiwoga Family was currently acting through a developer named Obatob Properties Limited, and fraudulently advertising government acquisition land for sale to the unknowing public for use as a residential estate, hinting that for reasons stated above the State government through the Ministry of Justice would be taking steps to set aside the judgment the Fibiwoga family and Obatob Properties Limited are laying claims to.
He declared that, the general public should hereby be put on notice that the claims of the Fibiwoga Family to own 350 hectares of land along Lagos Road, Apere Oba via Ijebu Ode, Ogun State were fictitious, fraudulent, and baseless.
Similarly, Obatob Properties Limited has no land to develop, assign, allot, or administer in the described area, any person or persons who deals with either entity or any other private person regarding the said land does so at their own risk.
